Terms of Service

These Terms of Service (the "Terms") govern your use of the web-based digital scale and survey platform operated by ScaleForm ("ScaleForm", "we", "the platform") in Türkiye. By accessing or using the platform, you agree to these Terms. If you do not accept these Terms, please do not use the platform.

1. Description of the Service

ScaleForm is a web-based digital scale and survey platform designed for researchers and academics. Through the platform you can:

• Create and edit Likert-type and similar scales and surveys.
• Collect responses from participants.
• Measure the completion time and timestamps of each response.
• Run automatic data-quality and suspicious-response checks.
• Export your data in CSV, Excel, and SPSS formats.

The platform is continuously evolving, and we reserve the right to change, add, or remove features from time to time.

2. Eligibility

The platform is offered primarily for research and academic use. To use the platform, you must:

• Be at least 18 years old, or hold valid authorization to act on behalf of your institution, and
• Have the legal capacity to enter into a binding agreement under applicable law.

If you create an account on behalf of an institution or legal entity, you represent that you are authorized to bind that entity to these Terms.

3. Account Responsibilities

You agree to provide accurate, current, and complete information when creating an account. You are solely responsible for the security of your account, including:

• Keeping your password confidential and not sharing it with third parties,
• All activity that occurs under your account,
• Notifying us promptly if you become aware of any unauthorized use.

4. Acceptable Use

When using the platform, you agree to the following rules:

• Do not create unlawful, harmful, deceptive surveys or surveys that infringe the rights of others.
• Obtaining the necessary informed consent from participants is the researcher's responsibility; ScaleForm is not responsible for obtaining such consent.
• Collect and process sensitive data (such as health, ethnicity, or beliefs) only in accordance with applicable law and relevant ethical rules.
• Do not attempt to gain unauthorized access to the platform, its infrastructure, or other users' data.
• Do not engage in spam, malware distribution, or automated abuse of the platform.

In the event of a violation of these rules, we reserve the right to remove the relevant content and to suspend or terminate your account.

5. Subscription and Billing

ScaleForm offers a free plan ($0) and a paid Researcher plan ($7/month). The Researcher plan is billed monthly, requires no commitment, and can be cancelled at any time.

All payments are processed by Paddle.com acting as the Merchant of Record. This means that Paddle issues the invoice for the sale, collects and remits global taxes such as VAT and sales tax, and handles refunds. ScaleForm does not store your card details; your payment data is processed securely and directly by Paddle.

• The Researcher plan renews automatically each month until you cancel.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

6. Intellectual Property

The form and scale definitions you create, and the participant responses you collect, belong to you. All rights in this content and data remain yours; ScaleForm holds only a limited right to process such data to the extent necessary to provide the service to you.

The platform itself, including its software, interface, brand, and all related intellectual property rights, belongs to ScaleForm. These Terms grant you only a personal, non-transferable right to use the platform and do not transfer any ownership rights to you.

7. "As Is" Provision and Limitation of Liability

The platform is provided "as is" and "as available". To the maximum extent permitted by applicable law, we make no warranties, whether express or implied, and we do not guarantee that the platform will be uninterrupted, error-free, or fit for a particular purpose.

To the extent permitted by applicable law, ScaleForm shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data. In any case, our total liability is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.

8. Termination

You may terminate your subscription and account at any time. If you breach these Terms, we may suspend access to or terminate your account. Following termination, except where we are required to retain data under applicable law, we may delete or anonymize your data within a reasonable period.

9. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes through appropriate means and update the effective date at the top of this page. Your continued use of the platform after the changes take effect constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye. The competent courts and enforcement offices of Türkiye shall have jurisdiction over any disputes arising from these Terms.
